Confidentiality in mediation is always a topic that raises a lot of discussion, this webinar will look at the topic not only from a legal framework perspective but more importantly how it does work in practice and what we need to consider when working with parties.

8 March (4.30pm – 8.00pm): Mediation practice refresher (#1)

Mediation refresher #1: This webinar will cover defining mediation and how it fits along the ADR spectrum. The different models of mediation will be identified and how they can assist in resolving different disputes. The focus of this webinar will be on the facilitative mediation model, what it looks like and the participants will be walked through the stages of the process and strategies and tips for working with the model will be highlighted.

Mediation refresher #2: This Professional Development webinar will focus on the skills associated with mediation, it will highlight the skills and how best to use them to assist parties in moving through the mediation process. It will also highlight some of the areas that give both new and experienced mediators difficulty, how to work with the impasses and obstacles that come in mediation and how best to handle highly conflictual parties and situations.

31 May 2022 (5.00pm – 6.30pm): The ‘Top Triangle’ in mediation: why is it so important for a successful outcome:

The ‘top triangle’ in mediation is all about issue identification , why is this so crucial and more importantly how to work through in the most effective way will be looked at in this webinar, focus will be on getting the most out of parties opening statement and creating an agenda that will focus the parties.

26 July (5.00pm – 6.30pm): Exploration, Option Generation and Obstacle Identification – the trinity of turning “wants to needs”.              

This webinar will focus on what are the critical stages of the mediation and in particularly the facilitative model. The webinar will look at strategies and tips to get the maximum benefit out of the exploration stage.

This webinar will focus on how to work in private session with the parties and then move onto negotiations remaining facilitative and focused on the outcomes acceptable to all parties. It will also highlight the various agreements and how to assist parties to finalise any arrangements.

There are many models of dispute resolution that can be used to assist parties in resolving their disputes, this webinar will look not at the models of dispute resolution but also the structures and identify how you need to consider them in the light of practice.
